At the Estate Planning & Elder Law Center of Brevard, we take a personal, hands-on approach: We will meet with you, face-to-face, take the time to get to know you, and gain a thorough understanding of your concerns and goals. Your legal matters will be handled professionally, respectfully, and expeditiously.
We take pride in working closely with our clients to ensure that they obtain the best representation for the investment. We limit our practice to Estate Planning, Elder Law, and closely related areas to provide the level of service and legal representation necessary to preserve our clients’ rights.
Our Founder, Robin M. Petersen, is Board Certified in Elder Law by the National Elder Law Foundation, which is accredited by the American Bar Association. He is honored to have received accreditation by the Department of Veterans Affairs (VA) to prepare, present, and prosecute claims for veterans before the VA. Accreditation refers to the authority granted by the VA to those attorneys who meet the standards established by the VA. The VA’s stated purpose in requiring attorney accreditation is to ensure that claimants for VA benefits receive “qualified assistance in preparing and presenting their claims.” Mr. Petersen is also admitted to practice before the U.S. Court of Military Appeals.
At the Estate Planning & Elder Law Center of Brevard, we offer the following services:
We assist individuals and families of all income levels through the minimization of Income, Gift and Estate Taxes, the drafting and use of many different types of Trusts to maintain control and protect assets, business succession planning for small business owners, and retirement planning.
Just having a well-written will or living trust does not mean that it will work properly. It must be integrated with planning for all assets. The comprehensive plan we recommended depends on the estate’s size, the type of assets in the estate, family dynamics, and the personal goals of the client.
In the ever-changing landscape of Elder Law, Mr. Petersen remains current with the latest rules and regulations. He will guide you through the complex maze of Medicaid laws; explain the options available to pay for home health care, assisted living and nursing home costs; assist you in qualifying for benefits; and implement a plan to protect your assets from nursing home costs to the furthest extent the law allows.
We also offer the more traditional Elder Law services, such as Guardianships and other protective proceedings, as well as planning for incapacity by utilizing “Advance Directives,” such as Durable Financial Powers of Attorney, Health Care Surrogate Designations, Living Wills, and Pre-Need Guardian Designations.
Probate and Trust Administration provided by the Estate Planning & Elder Law Center of Brevard often includes trust and estate planning and design, as well as trust and estate administration. Unlike some firms, if we have designed a plan, we remain available to administer it after the client’s death or incapacity.
Whether we have drafted the documents or not, we are also available to work with trustees for all types of trusts, and Personal Representatives (“Executors”) in probate situations, to efficiently streamline the post-death settlement process.
As a Veteran (Captain, U.S. Air Force JAG) and military brat, Mr. Petersen is unique in the level of passion he has for working with veterans and their surviving spouses to maximize available benefits that will enhance their lives. This, in turn, gives comfort to their families, knowing that loved ones are receiving better care. Unfortunately, many veterans, their families, attorneys, and other client advocates are either unaware such programs exist or are unable to successfully navigate the VA bureaucracy. We have a great deal of experience in this area and welcome the opportunity to assist you.
